Terms & Conditions – Friends Special (Subscription) 

Terminology:

Subscriber: refers to an individual/entity/organisation that has the right to access the subscription website via a subscription fee.

Subscription: refers to a right to use the applicable portion of the subscription education website as a subscriber under a paid subscription.

Website: means all information, content, concepts, program interfaces, structures, functionality, published materials, electronic documents and other technology inherent on the entire Forme Education website inclusive of the subscription education and the public website.

The company: Forme Education

Non-accredited: Non-formal learning/training that does not lead to a nationally recognised AQF qualification.

Written notice/written notice received:  All notices are issued in writing and may be given by any one of the following means:

a: by sending it to the address of the party and received is determined to be five (5) clear business days after the day of posting

b. by sending it by email to the email address of the party and received is determined to be on receipt of a successful transmission she

Subscriber rights and obligations

The subscriber will be granted access to the portion of the subscription website applicable to the subscription type. The subscriber agrees that access to, and use of, this site is subject to these terms and all applicable laws.

By agreeing to grant such access, the company may upgrade, modify, change or enhance the services and convert a subscriber to a new version at any time in its sole discretion, to the extent that is not detrimental to the subscriber’s use of the services and reasonable prior notice is provided to the Subscriber.   In the case that the change is of critical business importance or outside of the companies control, the company will provide the subscriber with a reason for the change as soon as reasonably practical.

The subscriber agrees to abide by any rules or regulations that the company publishes inclusive of the following:

  • will not rent, lease, sublicense, re-sell, distribute, transfer, copy or modify the services or any component thereof;
  • will not reproduce, distribute, modify or create plagiarised works of, publicly display, publicly perform, republish, download, store or transmit the services or any part thereof;
  • will not remove any copyright, trademark or other proprietary rights notices from copies of materials from the company’s website;
  • will inform the company with any changes to personal information and payment details in writing
  • Agrees to pay subscription fees set out in the access all subscription order summary located in the course enrolment section of the company website

Non-accredited training

The short courses accessed via subscription education are non-accredited therefore do not result in a Nationally Recognised Qualification being issued.

Third party sites and viruses

The company cannot guarantee that any downloadable content and/or execution from or via its site is free from viruses or other conditions, which could damage or interfere with data, hardware or software with which it might be used.   The subscriber assumes all risk of use of programs and files and release the company of all responsibilities for any consequences of its use.

Links to third party sites may be contained in some of the learning resources accessible. The company is not responsible for the condition or content of those sites.

Company obligations

The company will ensure commercially reasonable efforts to enable to the site to be accessible, except for any interruptions beyond the reasonable control of, or not reasonably foreseeable by the company.

Forme education will provide reasonable notice of any upgrades, scheduled maintenance and required repairs except for any interruption due to causes beyond the reasonable control of the company.

Data collected by the company is handled sensitively and in accordance with Australian Privacy Law as set out in the Privacy Act 1988 (“Privacy Act”) including the legally binding Australian Privacy Principles.

Payments

The company will endeavour to contact you via email to inform you of any overdue payments, in the event you cannot be contacted you will be provided with Written Notice of overdue payments

Repeated failures to meet your payment obligations without prejudicing the company’s rights to recover any overdue payments, the subscription may be suspended or terminated by Written Notice

The company reserves the right, at any time to change the subscription fees charged. The company agrees to use reasonable endeavours to provide you with Written Notice of the changes. The changes will take effect 30 days after the Written Notice has deemed to have been received by the subscriber. The company deem receipt to have occurred two (2) business days after the Written Notice was sent. At the end of the 30 day period, the Subscriber authorises the Company to apply the new amount.

Cancellation

The subscriber must inform the Company in writing of the intent to cancel the subscription.

The cancellation will take effect at the end of the current subscription month.

The company must be provided up to five (5) business days to process the cancellation request. Therefore, should the cancellation be requested less than five (5) business days prior to the monthly payment due date, the cancellation will take effect for the following month.

The full monthly fee for any month (or portion thereof) of any subscription elapsed is non-refundable, regardless of whether you logged onto the Company Website or accessed the respective learning resources during that month.

The company does not provide refunds for any fees or charges for monthly subscription products.
